1. Acceptance of Terms
By accessing or using the SIMULATION platform ("Service") at simulation-auto.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
SIMULATION provides an AI-powered business automation platform including WhatsApp messaging, workflow automation, customer management, and analytics tools for businesses primarily operating in East Africa.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of any unauthorized use of your account.
- One person or entity may not maintain more than one free account.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or violate Meta's WhatsApp Business Policy.
- Transmit illegal, harmful, or fraudulent content.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service for any purpose that violates applicable laws or regulations.
5. WhatsApp Business API
Use of WhatsApp features through our platform is subject to Meta's WhatsApp Business Policy and Meta Platform Terms. Violation of these policies may result in suspension of your WhatsApp access.
6. Payment & Billing
Paid plans are billed in advance. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by SIMULATION and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of data you upload or create using the Service.
9. Limitation of Liability
To the maximum extent permitted by law, SIMULATION shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Continued use of the Service after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved in the courts of Dar es Salaam, Tanzania.
